RUSH GADGETS LTD. REPAIR TERMS AND CONDITIONS

General Terms

  • Acceptance: By engaging with Rush Gadgets Ltd. for repair services, the customer agrees to be bound by these Repair Terms and Conditions.
  • Service Scope: Repair services are limited to smartphones, tablets, and other mobile electronic devices.
  • Refusal of Service: Rush Gadgets Ltd. reserves the right to refuse service for any device that is deemed by our technicians to be beyond repair, has been tampered with, or for any other condition that might affect our ability to perform a repair.
  • Inspection: Initial inspection of the device will be performed to determine the nature of the repair required. The customer acknowledges that this inspection may result in additional recommendations for service.
  • Repair Risk: While Rush Gadgets Ltd. will take utmost care in repairing the customer’s device, the customer acknowledges that repairs may result in the loss of data, changes to the device’s functionality, cosmetic damage and other complications not specified here.

Service Authorization

  • Work Authorization: The customer hereby authorizes Rush Gadgets Ltd. to perform the repair work on their device as detailed in the Service Quotation/Work Order provided following the initial inspection.
  • Repair Process: Rush Gadgets Ltd. commits to using qualified technicians and appropriate tools to perform repair services. The repair process may involve the use of both OEM (Original Equipment Manufacturer), high-quality third-party or partially genuine components, at the discretion of Rush Gadgets Ltd.
  • Repair Timeframe: While Rush Gadgets Ltd. will aim to complete repairs in a timely manner which is within 7 business days, the customer acknowledges that the estimated completion time may vary depending on the complexity of the repair and availability of parts.
  • Additional Authorization: If during the repair, additional issues are discovered that were not identified in the initial Service Quotation/Work Order, Rush Gadgets Ltd. will seek additional authorization from the customer before proceeding with any further repairs that will affect the cost or repair time.

Estimates and Approval

  • Provision of Estimate: Following a diagnostic or visual assessment, Rush Gadgets Ltd. will provide the customer with a written or electronic estimate of the costs associated with the repair, including parts and labor.
  • Approval Requirement: The customer must approve the estimate before any repair work commences. Approval may be given in writing, electronically, or verbally, but must be documented by Rush Gadgets Ltd.
  • Validity of Estimate: Estimates are valid for a period of 24-hours, within which time customer approval must be received to ensure pricing. However, part availability cannot be guaranteed.
  • Estimate Amendments: Should there be a need to adjust the estimate based on findings during repair, Rush Gadgets Ltd. will halt all work and seek further approval from the customer before proceeding, except where it is required for the safe completion of the work outlined in the service estimate or the customer provides their own parts.
  • Customer Declines Repair: If the customer declines the repair after the estimate is given, Rush Gadgets Ltd. may charge a diagnostic fee of up to $50 BBD, whether or not it is outlined in the Service Quotation/Work Order.

Parts and Labor

  • Parts Quality: Rush Gadgets Ltd. will use new, or refurbished parts that are high-quality third party, OEM or refurbished OEM. All of which will meet, or have similar performance to the OEM part.
  • Labor Guarantee: Labor performed by Rush Gadgets Ltd. is guaranteed for 7-days from the date of service. Should a repair fail due to the quality of workmanship or negligence, Rush Gadgets Ltd. will perform further repairs free of additional labor charges.
  • Ownership of Replaced Parts: All defective or replaced parts become the property of Rush Gadgets Ltd. unless the customer requests their return at the time-of-service approval, with the exception of data storage devices.
  • Labor Costs: Labor costs will be based on the current rates provided in the Service Quotation/Work Order and will only be billed for the actual work performed.

 

Service Warranty

  • Warranty Period: Rush Gadgets Ltd. provides a ninety (90) day warranty on repairs starting from the date the repaired item is collected by the customer. This warranty covers defects in parts installed and the labor associated with the repair.
  • Coverage Limitations: The warranty does not cover physical damage, liquid damage, or issues resulting from misuse of the device after the repair. Additionally, the warranty does not cover problems unrelated to the original repair or parts not replaced by Rush Gadgets Ltd.
  • Warranty Claims: To claim a warranty service, the customer must present proof of purchase and/or proof of repair. Rush Gadgets Ltd. will diagnose the problem free of charge and, if the issue falls under the warranty, perform repairs at no additional cost for parts or labor.
  • No Warranty on Certain Repairs: Certain types of repairs, including but not limited to, network and passcode unlocking, software-related issues, data recovery, board repairs, repairs that do not require the device to be opened, repairs that do not require any parts to be replaced, cosmetic refurbishments, labor only repairs, repairs that involved parts provided by the customer are not covered by our standard warranty.
  • Voiding of Warranty: The warranty will be be voided if the device had moisture inside it, has any signs of physical damage, was opened, modified, or repaired by a third party after the initial repair by Rush Gadgets Ltd., or if the device’s serial number has been removed or altered.
  • Exclusion of Consequential Damages: Rush Gadgets Ltd. shall not be liable under this warranty for any loss of data, loss of revenue or profit, or any special, incidental, or consequential damages caused by the use, misuse, or inability to use the device.
  • Repair After Warranty Expiry: If the device requires service after the warranty period has expired, a new estimate will be provided, and the repair will be treated as a new service transaction.

Device Functionality Testing

  • Pre-Repair Testing: Prior to conducting any repair services, Rush Gadgets Ltd. will perform a functionality test on the customer’s device to determine the current operational status. This test will assess various functions of the device to establish a repair baseline and identify any pre-existing conditions that may affect the repair process.
  • Customer Presence Recommended: Customers are encouraged to be present during the pre-repair testing to acknowledge the device’s condition and functionalities tested. If the customer is not present, Rush Gadgets Ltd. will document the test results and provide them to the customer.
  • Post-Repair Testing: Upon completion of the repair, the device will undergo a post-repair functionality test to ensure that the repair was successful and that the device is performing according to the expected standards. The results of this test will be recorded and made available to the customer.
  • Warranty Validity: The warranty provided by Rush Gadgets Ltd. is contingent upon the successful completion of both pre-repair and post-repair testing. Failure to complete either of these tests for any reason will void the warranty provided.

 

Customer Responsibilities

  • Data Backup: Customers are responsible for backing up all data on their device prior to submitting it for repair. Rush Gadgets Ltd. will make reasonable efforts to preserve the data on the device and protect it; however, we cannot guarantee the integrity of data during repairs. Rush Gadgets Ltd. is not responsible for the loss, corruption, or breach of data on customer’s devices.
  • Accurate Information: Customers must provide accurate and detailed information regarding the issues with their device, as well as any passwords or access codes necessary to complete the repair. Failure to do so may result in incomplete or delayed services.
  • Disclosure of Previous Repairs and Issues: Customers should disclose any previous repairs or alterations made by third parties to their device, as this may affect our ability to repair the device and could void the service warranty offered by Rush Gadgets Ltd.
  • Removal of Personal Items: Before service, the customer must remove any protective cases, SIM cards, SD cards, and other accessories from the device. Rush Gadgets Ltd. is not responsible for the loss of any accessories.
  • Service Readiness: The customer is responsible for ensuring that their device is ready for service, which includes disabling all forms of security locks and encryption to allow access to the device for diagnostics and repair. Failure to do this will result in the service warranty being voided.

Liability Limitations

  • Maximum Liability: In no event shall Rush Gadgets Ltd. be liable for more than the total amount paid by the customer for the repair services.
  • Indirect Damages: Rush Gadgets Ltd. is not liable for any indirect, special, incidental, or consequential damages arising out of the service provided.
  • Data Loss: While Rush Gadgets Ltd. will take care to preserve the data on the customer’s device, we cannot be held liable for the loss or corruption of data, programs, or loss of use of equipment arising out of the services provided.
  • Damage During Service: Rush Gadgets Ltd. is not responsible for any damages or malfunctions not related to the repair service performed that may come to light during or after the service is completed. Any such issues will be communicated to the customer, and a separate repair may be proposed.
  • Unforeseen Complications: In the event of unforeseen complications arising during the repair process, Rush Gadgets Ltd. will contact the customer to discuss potential impacts and solutions. However, Rush Gadgets Ltd. will not incur additional costs without customer approval.

Unclaimed Devices

  • Notification of Completion: Customers will be notified via their provided contact details once their device repair is complete. It is the customer’s responsibility to collect their device in a timely manner.
  • Storage Fee: Devices not collected within thirty (30) days from notification of repair completion may incur a storage fee, specified at the time of repair notification.
  • Abandonment: If a device is not collected within ninety (90) days from the notification of repair completion, the customer acknowledges that the device will be considered abandoned. Rush Gadgets Ltd. reserves the right to dispose of the device in any manner, including sale, recycling, or use for parts, to recoup the cost of services rendered.
  • Abandonment Communication: Prior to treating the device as abandoned, Rush Gadgets Ltd. will make reasonable efforts to contact the customer using the information provided at the time of service.
  • Waiver of Ownership: By leaving a device unclaimed past the ninety (90) day period, the customer waives any claim to the device or any data contained within it.
  • Data Removal: For abandoned devices, Rush Gadgets Ltd. will remove and securely wipe any customer data before disposal.

 

Payment Terms

  • Completion of Service: Full payment is due upon completion of the repair and prior to the release of the repaired device to the customer.
  • Accepted Payment Methods: Rush Gadgets Ltd. accepts payments in the form of cash, credit/debit cards, and other pre-approved electronic payment methods. All payments must be made in Barbadian dollars unless otherwise specified.
  • Late Payment: If the customer fails to make payment within fourteen (14) days of the repair being completed and notified, a late fee may be added to the total amount due.
  • Non-Payment: In the case of non-payment, Rush Gadgets Ltd. reserves the right to retain the device as collateral until full payment is made. Further, Rush Gadgets Ltd. may initiate collection procedures and the customer will be responsible for any legal fees, collection fees, and other expenses involved in the collection process.
  • Estimate Deposit: For extensive repairs requiring special-order parts, Rush Gadgets Ltd. may require a deposit, which will be detailed in the Service Quotation/Work Order. This deposit is non-refundable should the customer cancel the service after the parts have been ordered.
  • Refunds: In the event that a repair cannot be completed, the customer will be entitled to a full refund of any payment made for that specific repair service. This does not include diagnostic fees or other non-repair related charges.

Privacy Policy

  • Personal Information: Rush Gadgets Ltd. is committed to protecting the privacy of our customers. Personal information collected for business purposes, such as customer names, addresses, phone numbers, email addresses, passwords or identification numbers will be used solely for the purpose of conducting business with Rush Gadgets Ltd., including repair notifications, service updates, and customer service communication.
  • Confidentiality: All personal and device data accessed during the course of repair will be treated as confidential. Technicians at Rush Gadgets Ltd. are bound by confidentiality agreements to ensure that customer data is protected and not disclosed, shared, or used for any purpose other than the repair.
  • Data Access: During the repair process, it may be necessary to access device data to verify the repair’s success. Rush Gadgets Ltd. will limit data access to the minimum required and will not copy or distribute data unless explicitly authorized by the customer for the purposes of data transfer or backup.
  • Data Retention: Any customer data acquired during the diagnostic or repair process will not be retained by Rush Gadgets Ltd. after the completion of the repair, except as necessary for warranty or return purposes.
  • Security Measures: Rush Gadgets Ltd. employs reasonable and appropriate security measures to protect against unauthorized access to, or alteration or destruction of, personal information in our possession.
  • Information Disclosure: Rush Gadgets Ltd. will not disclose personal information to third parties without consent, except where required by law or to facilitate warranty claims or external repair services with the device manufacturer or authorized service provider.
  • Policy Updates: This privacy policy may be updated from time to time. Customers will be notified of any significant changes that affect the handling of their personal information.

Changes to Terms and Conditions

  • Notice of Changes: Rush Gadgets Ltd. reserves the right to make changes to these terms and conditions at any time. When changes are made, customers will be notified through our official channels, which may include in-store postings, email notifications, updates on our official website or social media.
  • Acceptance of Changes: Continued use of our services after changes to the terms and conditions will constitute acceptance of the new terms. If a customer disagrees with the changes, they should cease using our services immediately.
  • Documenting Changes: A history of amendments will be maintained by Rush Gadgets Ltd. and made available to customers upon request to ensure transparency in our service terms over time.

Governing Law

  • Jurisdiction: These terms and conditions, and any dispute arising from the services provided by Rush Gadgets Ltd., shall be governed by and construed in accordance with the laws of Barbados.
  • Legal Compliance: Rush Gadgets Ltd. agrees to perform all repair services in compliance with the applicable laws and regulations in Barbados.
  • Dispute Resolution: In the event of a dispute, Rush Gadgets Ltd. and the customer will first seek to resolve the matter amicably through direct negotiation. Should these attempts fail, both parties agree to resolve any disputes through binding arbitration or small claims court, subject to the laws of Barbados.

Acceptance of Terms

  • Agreement to Terms: By submitting your device for repair, you acknowledge that you have read, understood, and agreed to be bound by these terms and conditions.
  • Written Acknowledgment: Customers may be asked to sign a written acknowledgment of these terms and conditions upon submission of their device for repair, which will serve as a formal agreement to the stipulated terms.
  • Pre-Service Agreement: It is the responsibility of the customer to read and understand these terms before authorizing any repair work. Rush Gadgets Ltd. staff are available to clarify any aspects of the terms and conditions upon request.

Rush Gadgets 30-Day Limited Product Warranty

Warranty Agreement

By purchasing or using product or accessory product (“Product”) from Rush Gadgets, you agree to be bound by the terms of this Rush Gadgets 30-Day Limited Warranty (“Warranty”). Please read this Warranty carefully before using your Product. If you do not agree with the terms of this Warranty, do not use the Product and return it within 24 hours of purchase.

Warranty Limitations Subject to Consumer Law

To the extent permitted by law, this Warranty and the remedies provided are exclusive and replace all other warranties, remedies, and conditions, whether oral, written, statutory, express, or implied.

Duration of This Warranty

This Warranty is effective for 30 days from the date of the original retail purchase by the end-user purchaser (“Warranty Period”).

Eligibility and Proof of Purchase

This Warranty is only valid for the original purchaser who acquired the Product at the original Rush Gadgets location it was purchased from. Rush Gadgets also reserves the right to require proof of purchase and identification as part of the warranty claim process.

 

What Is Covered by This Warranty?

This Warranty covers products resold by Rush Gadgets against defects in materials and workmanship for a period of 30 days from the date of purchase.

 

What Is Not Covered by This Warranty?

The following may also void this warranty:

  1. Products covered by a manufacturer’s warranty. For issues with such Products, please consult the manufacturer.
  2. Damage due to negligence, purposeful tampering, or any modification of the Product by an individual or entity other than Rush Gadgets.
  3. Damage caused by any liquid, misuse, fire, or other external causes.
  4. Cosmetic defects such as blemishes, scratches, dents, and nicks.
  5. Damage caused by using the Product with accessories not certified or approved for use by the manufacturer.
  6. Products sold AS-IS, or has issues specified in description.
  7. Products network locked, password protected, iCloud locked, Google locked.

Note: Misuse will be based on the manufacturer’s guidelines for how their Product should be used.

 

Compensation Options

In the event of a valid warranty claim, Rush Gadgets will, at their sole option, select one of the following compensation options:

  1. Repair the defective Product using new or previously used parts that have been tested and passed functional requirements.
  2. Replace the defective Product with a replacement Product of the same model (or with a product that has the same or substantially similar features as the original product).
  3. Exchange the defective Product for a refund of your purchase price. Although this can be subject to a restocking fee which will be calculated by Rush Gadgets.
  4. Compensate you with cash, a fair amount for the defect, however, this option will void the remainder of this warranty.

Your Responsibilities

Before seeking warranty service, you are responsible for reviewing and understanding the warranty coverage provided by us. If the Product is covered by a manufacturer’s warranty, you should contact the manufacturer for warranty service instead, as you will not be eligible for compensation under this warranty policy. Before submitting your Product for warranty service, you should maintain a separate backup copy of the contents of its storage media, remove all information that you want to protect, and disable all security passwords.

Limitation of Liability

Rush Gadgets is not responsible for any damages resulting from a breach of warranty, including direct, special, incidental, or consequential damages. This Warranty does not cover any labor costs you may incur. Rush Gadgets is not responsible for any loss of software programs, data, or other information on the Product. Rush Gadgets does not guarantee that it will be able to repair any Product under this Warranty without risk to or loss of information stored on the Product.

General

This Warranty is governed by and construed under the laws of Barbados. No Rush Gadgets reseller, agent, or employee is authorized to make any modification, extension, or addition to this Warranty. If any term of this Warranty is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.

Manufacturer’s Warranties

If the Product you have purchased comes with a manufacturer’s warranty, please consult the manufacturer for any defects as they will be responsible.

Rush Gadgets Ltd. Special Order Policy

Purpose

To provide clear guidelines for handling special orders of smartphones, tablets, and related accessories that
are not readily available in our inventory.

 

Policy Scope

This policy applies to all special
orders placed with Rush Gadgets Ltd. for products that need to be ordered from
suppliers or manufacturers.

 

Order Process

  • Customer Request: Customers may request special orders
    for items not in stock by contacting our sales team.
  • Product Availability Check: Our team will check the availability of
    the requested item with our suppliers.
  • Provision of Estimate: We will provide the customer with an
    estimated cost and delivery time for the special order.

 

Order
Confirmation

  • Deposit Requirement: A non-refundable deposit of 50% of the
    total estimated cost is required to confirm the special order. This
    deposit will be applied to the final purchase price.
  • Customer Acknowledgement: Upon making a payment or accepting a
    special ordered product, the customer accepts these terms and conditions.

Order Fulfillment

  • Supplier Order: Once the deposit is received, Rush
    Gadgets Ltd. will place an order with the supplier.
  • Delivery to Rush Gadgets Ltd.: Upon receiving the item, we will
    inspect it for quality and completeness.
  • Notification of Arrival: The customer will be notified when the
    item is available for pickup or ready for delivery.

 

Payment and
Collection

  • Final Payment: The remaining balance of the order must
    be paid upon collection or before delivery of the item.

 

Cancellation and Refunds

  • Cancellation by Customer: If a customer cancels a special order
    after the order is placed with the supplier, the deposit will not be
    refunded.
  • Cancellation by Rush Gadgets Ltd.: If we are unable to fulfill the order by the pickup deadline,
    the customer will be eligible to receive a full refund of the deposit.
  • Money-back Guarantee.: If order is not correct or the quality of the product is not as advertised upon collection, the customer will be eligible to receive a full refund of the order, Rush Gadgets Ltd. reserves the right to refund in whatever means they desire, whether store credit, cash, cheque or bank transfer.

 

Abandoned Special Orders

  • Definition of Abandonment: A special order will be considered
    abandoned if it is not collected within 30 days from the notification of
    arrival.
  • Efforts to Contact: Rush Gadgets Ltd. will make reasonable
    efforts to contact the customer using the provided contact details.
  • Storage Fee: A storage fee of %10 of the estimated
    total may be charged for items held beyond the 30-day period, calculated
    on a per-day basis.
  • Disposition of Abandoned Orders: If the item remains uncollected after
    60 days, Rush Gadgets Ltd. reserves the right to dispose of the item as
    deemed fit. This may include sale, recycling, or use as store stock.
  • No Refund for Abandonment: The customer will forfeit the deposit
    and any rights to the item once it is considered abandoned.

Special Orders Picked Up Late

  • Late Pickup Notice: If a customer anticipates a delay in
    picking up a special order, they must inform Rush Gadgets Ltd. in advance.
  • Extended Storage Agreement: Rush Gadgets Ltd. may agree to hold the
    item for an extended period, subject to storage fees, based on
    availability and storage capacity.
  • Waiver of Liability: Rush Gadgets Ltd. is not liable for any
    loss or damage to the item during the extended storage period.

 

Warranty and Returns

  • Special order items are subject to the
    same warranty and return policies as regular inventory items.

 

Liability

  • Rush Gadgets Ltd. is not responsible
    delays or discontinued items after an order has been placed.

 

Changes to the Policy

Rush Gadgets Ltd. reserves the right to modify this Special Order Policy at any time.
